ACCEPTABLE FORMS OF IDENTIFICATION

In order to obtain a Police Criminal Record Check, two (2) pieces of valid (not expired) government issued identification must be provided. Proof of the applicant’s name, date of birth, address, signature and photo must be provided.

VULNERABLE SECTOR VERIFICATION

The vulnerable sector verification is used to determine if an individual applying to volunteer or work in a position of trust or authority with vulnerable persons has any convictions for a sexual offence listed in the Criminal Records Act for which a pardon was granted. In some cases, fingerprints may be required for submission to the RCMP National Repository of Criminal Records to complete the verification.

Vulnerable persons are defined in the Criminal Records Act as persons who, because of age, a disability, or other circumstances, whether temporary or permanent are

  1. In a position of dependence on others, or
  2. Are otherwise at a greater risk than the general population of being harmed by a person in a position of authority or trust relative to them.

Any individual applying for work in a paid or volunteer position where they will be in a position of trust or authority of a vulnerable person may be required to complete a Vulnerable Sector Verification. Some examples of positions involving members of the vulnerable sector are: teachers, social workers, day-care workers, sport coaches and volunteers.

The Police Service will complete a Vulnerable Sector Verification based on the applicant’s name, date of birth and gender. If no record is found, a completed Police Vulnerable Sector Verification will be provided to the applicant.

If the Vulnerable Sector Verification is inconclusive, a fingerprint-based search will be required. If the RCMP confirms that the applicant has a pardoned sex -offence, the information will be forwarded to the Minister of Public Safety to authorize disclosure of all or part of the information contained in the file. When the information is authorized for disclosure by the Minister, the criminal record associated with the applicant’s fingerprints will be returned to the Service and will include the pardoned sexual offene information. At this point the Service will be required to obtain the applicant’s consent in writing for disclosure of the record(s). When the applicant has signed the form giving consent to release the record(s), the Service must forward the information to the requesting agency (employer or volunteer agency).s

If the applicant chooses not to disclose their record(s), the Service will contact the requesting agency in writing indicating that the Service was unable to complete the Police Vulnerable Sector Verification.

The Brandon Police Service has the right to refuse to do a Vulnerable Sector Verification if they feel that the position does not meet the definition of a vulnerable sector check.

 

CERTIFIED CRIMINAL RECORD

For those individuals with criminal records, the Brandon Police Service will not release the details of the criminal record. To obtain a certified copy of your criminal record, you must be fingerprinted by the Brandon Police Service which will be submitted to the RCMP in Ottawa. The RCMP will respond by letter directly to the applicant who in turn, will produce the results of the Criminal Record to the Organization/Firm or Company.

 

SELF-DECLARATION

A person may self-declare their conviction history. Self-Declaration should NOT include:

  • Absolute/conditional discharges
  • Conviction for which you have received a pardon
  • Youth convictions (Youth Criminal Justice Act (YCJA))
  • Offenses where there were no convictions
  • Provincial/Municipal offenses
  • Any charges dealt with outside of Canada
  • Any charges for which you received a stay of proceedings

 

If the self-declaration matches the RCMP National Repository records, the Brandon Police Service will confirm the results of the criminal convictions as declared by the applicant. If the RCMP National Repository records do not match the self-declaration, fingerprints must be submitted to obtain a certified copy of your criminal record from the RCMP in Ottawa.

Youth Records – Generally the Brandon Police Service will not do a Criminal Record Check on persons under 18 for the purposes of employment or volunteering. Youth records remaining on the record for specific purposes and periods listed in Section 119(1) and (2) after the person becomes an adult will not be released unless they are granted specific access under those sections of the Youth Criminal Justice Act. Youth records may be disclosed to the Government of Canada or the government of a province or municipality for the purposes of employment or obtaining services. They may not be disclosed to other, non-government employers or organizations for which volunteer services are to be performed. The criminal record may be released to a consenting youth.

 

RESULTS

Your request will be processed in order of receipt. Completion dates are subject to the complexity and volume of individual requests and the availability of resources to process those requests. Please check with our staff when submitting your request for an approximate return date.

The results of the check will be mailed to the applicant or the person authorized by the applicant. The results indicate which searches have been undertaken, as well as the appropriate standard response and criminal history, if applicable.

The results are usually released to the consenting applicant. However, with specific written consent it may be released directly to a third party after being verified by the applicant or by fingerprint confirmation.
